It is advisable to read case law interpreting waiver of the attorney-client and work-product privileges regarding an investigation before an investigator is hired so you can make an intelligent decision in deciding whether you want somebody in house or outside to conduct an investigation. See Kaiser v. Superior Court, 66 Cal. App. 4th 1217, (1998) (employer does not automatically waive attorney client privilege or work product privilege as to confidential communications between employer's nonattorney investigator and the employer's attorney during an investigation); Wellpoint Health Networks v. Superior Court, 59 Cal. App. 4th 110 (1997 ) (attorney client privilege and work product waived when employer's attorney conducts investigation and employer put the adequacy of the investigation directly at issue)
